SHOP POLICIES, TERMS, RULES, SHIPPING
& DISCLAIMERS
Applies to: In-store purchases, online purchases, events, services, and all visitors.
1) AGREEMENT TO TERMS
By entering Highly Mystical Creations (the “Shop”), using our website, placing an order, booking a service, purchasing a ticket, or attending any event, you (“Customer/Guest”) agree to these Policies, Terms & Disclaimers (the “Terms”).
If you do not agree, do not enter the premises, use the website, or purchase/participate.
Highly Mystical Creations reserves the right to:
- Update or modify these Terms at any time without prior notice

Refuse service or access for any lawful reason

Interpret and enforce these Terms at staff discretion

Limit quantities, cancel orders, and correct errors
2) INCLUSIVITY, COMMUNITY & CODE OF CONDUCT
Respect for All / Zero Tolerance
Treat all staff, customers, artisans, facilitators, and guests with kindness, empathy, and respect. Harassment, discrimination, hate speech, intimidation, stalking, threats, or derogatory comments are prohibited and may result in immediate removal and permanent ban.
LGBTQ+ & Family-Friendly Space
We are a safe, welcoming, affirming space for LGBTQ+ individuals and families of all kinds. Any behavior that targets identity, orientation, gender expression, disability, religion, or culture will result in immediate enforcement.
No Judgment Zone
All spiritual practices are honored here. Do not mock, shame, debate aggressively, or demean other beliefs or practices.
No Proselytizing / Recruitment
No preaching, converting, pressuring, or recruiting for religious/spiritual groups, conspiracies, or organizations. No distributing materials without explicit shop permission.
Be Mindful of Others (Energy + Comfort)
Respect personal space, sensory needs, and the shared environment. Keep voices at a reasonable level. Avoid dominating shared areas.
No Disruptive Behavior
No yelling, aggressive arguments, intoxication, impairment, or hostile behavior. Staff may ask any individual to leave immediately.
Staff Boundaries
Staff are here to assist with products and general guidance. Staff are not available for personal counseling, crisis support, or extended emotional processing. For urgent mental health crises, call 988 (U.S.) or local emergency services.
Photography & Recording
Ask permission before photographing or recording staff or other customers. Recording events/classes may be restricted. Unauthorized recording may lead to removal. We reserve the right to prohibit photography at any time.
Pets (Restrictions + Liability)
Leashed, well-behaved, human- and pet-friendly pets are welcome. Service animals are always permitted. Any animal that is disruptive, aggressive, or uncontrolled must be removed immediately. Owners assume full responsibility and liability for any injury, damage, or disruption caused by their animal.
Children & Minors
Children are welcome but must be supervised at all times. Parents/guardians are responsible for:

Preventing damage or breakage

Any injury sustained on premises
Minors may not participate in certain services/events without a guardian and/or written consent where required.
3) SAFETY, LOSS, AND PERSONAL PROPERTY

Watch your belongings at all times. We are not responsible for lost, stolen, or damaged personal items.

Walk carefully—some items are fragile. You assume the risk of normal retail hazards.

Staff-only areas are off limits. Entering staff areas without permission may result in removal.
4) MERCHANDISE HANDLING & DAMAGE RESPONSIBILITY
Handle Items Respectfully
Please handle all merchandise gently. If you are unsure whether something may be touched, opened, smelled, or tested, ask first.
Breakage / Damage
If an item is damaged due to Customer handling (including children or pets), the Customer is responsible for purchasing the item at full price.
Natural Variations
Many items are handmade or natural and may vary in color, size, shape, texture, scent, or finish. These are not defects.
5) THEFT / SHOPLIFTING / FRAUD POLICY (ZERO TOLERANCE)
Theft is not tolerated. We use surveillance cameras and loss prevention measures.
If theft is suspected or confirmed, we reserve the right to:

Detain merchandise and refuse checkout

Require the individual to leave immediately
-
Issue a permanent ban
-
Contact law enforcement
-
Pursue civil recovery for losses and costs where permitted

Share evidence with authorities
We also reserve the right to refuse service to anyone engaging in suspicious behavior including tag switching, concealment, distraction tactics, or coordinated theft attempts.
6) PRICING, PROMOTIONS, DISCOUNTS & ERRORS

Prices and promotions may change without notice.

Discounts cannot be applied retroactively.

We reserve the right to correct pricing errors (in-store or online) and cancel/refund an order placed with an incorrect price due to a mistake, misprint, or technical error.

Coupons/discount codes may have limits and may be revoked in cases of misuse.
7) IN-STORE PURCHASES: RETURNS / EXCHANGES / STORE CREDIT

All in-store sales are final. We do not offer returns, exchanges, or refunds.
Case-by-Case Exceptions (Rare)
We may consider an exception only if:

The issue is caused by our error (wrong item, damaged at time of sale, defective)

Reported within 48 hours

Proof of purchase is provided
-
Item is unused and in original condition
Approved exceptions may result in store credit or replacement at our sole discretion. Refunds are not guaranteed.
No Returns For
No returns/exchanges on:

Crystals, stones, minerals

Plants
-
Apothecary goods (oils, sprays, salts, herbs, teas, bath items)

Candles, incense, wax melts
-
Jewelry (for hygiene reasons)

Spell kits, ritual items

Clearance/discounted items

Custom or special orders

Artisan goods

Any item once used/opened
“Once You Leave the Shop”
Once you leave the premises, you assume responsibility for the item’s condition, care, storage, and use. We are not responsible for damage, breakage, melting, fading, misuse, or dissatisfaction after departure.
8) ONLINE ORDERS: TERMS, SHIPPING, DELIVERY & CLAIMS
Order Acceptance
Placing an order does not guarantee acceptance. We may cancel orders due to inventory errors, suspected fraud, pricing mistakes, carrier restrictions, or policy violations.
Address Accuracy
Customers must provide a complete and accurate shipping address. We are not responsible for orders shipped to an incorrect address provided by the Customer. If a package is returned to us due to address error, reshipping costs are the Customer’s responsibility.
Processing Times
Processing times are estimates and do not include carrier transit time. Delays can occur during peak seasons, weather events, supply issues, or staffing constraints.
Shipping Carriers & Transit Delays
Once a package is scanned and accepted by the carrier, delivery is controlled by the carrier. We are not responsible for transit delays, missed delivery scans, or carrier service interruptions.
Tracking
Tracking is provided when available. “Delivered” scans are treated as proof of delivery. If tracking shows “Delivered,” the Customer must check:

mailbox/parcel locker

front/back door and surrounding area
-
neighbors/building management
-
local post office/carrier depot
We are not responsible for theft after delivery.
Lost or Missing Packages
If a package appears lost:

Customer must notify us within 7 days of the last tracking update

We may assist with a carrier claim, but outcomes depend on carrier policies
Replacements/refunds for lost packages are not guaranteed unless the carrier approves a claim or shipping insurance applies (if purchased/available).
Damaged Packages (Shipping Damage)
If items arrive damaged:

Customer must contact us within 48 hours of delivery

Provide photos of: outer box, shipping label, packing materials, and damaged item(s)
We may, at our discretion, offer replacement, store credit, or assist with a carrier claim. Claims submitted late may be denied.
Shipping Restrictions
Some items may be restricted due to:

carrier rules
-
heat/cold sensitivity (candles, plants)
-
fragile nature (crystals/glass)
We may limit shipping or require upgraded shipping methods at our discretion.
Weather / Heat / Cold Disclaimer
We are not responsible for damage caused by temperature exposure during transit (melting, freezing, leaf drop, plant shock). Ordering during extreme temperatures is at the Customer’s risk unless an agreed upgrade (e.g., faster shipping, insulation) is offered.
Refused or Returned Packages
If a package is refused or returned (unclaimed, wrong address, “return to sender”):

Original shipping fees are non-refundable

Reshipping fees apply
-
If a refund is issued, it may exclude shipping/handling and may be issued as store credit
Local Pickup / In-Store Pickup
Pickup orders must be collected within 3 business days. Unclaimed orders may be cancelled and restocking fees may apply.
9) CHARGEBACKS, DISPUTES & FRAUD PREVENTION
We take fraud seriously. If a Customer initiates a chargeback without contacting us first:

We may permanently ban the Customer from purchasing

We may provide evidence (tracking, delivery confirmation, messages, CCTV where applicable) to the processor
-
Orders flagged for fraud may require ID verification and/or matching billing/shipping info
10) EVENTS, WORKSHOPS, CLASSES & TICKET POLICY
No Refunds (Strict)
All event tickets, workshops, classes, circles, and gatherings are non-refundable and non-transferable unless approved.
No refunds for:

no-shows

scheduling conflicts
-
illness/emergencies
-
weather
-
transportation issues
-
personal circumstances
Transfers (At Our Discretion)
Transfers may be allowed only if requested at least 48hours before the event and only when feasible. Approval is not guaranteed.
Late Arrival / Early Departure
Late arrival may result in denied entry or missed content. No refunds or credits.
Materials & Seating
Your ticket helps pay for materials, prep, staffing, and facilitator costs. Limited seating is reserved for ticket holders only.
Event Behavior
We reserve the right to remove any attendee who violates shop rules. Removal does not entitle the attendee to a refund.
Photos at Events
We may photograph events for marketing. If you do not wish to be photographed, notify staff upon arrival. We will do our best to accommodate, but cannot guarantee exclusion from background shots.
Health & Accessibility
Some events involve scents (incense, oils), sound (music/sound baths), herbs, smoke-free alternatives, or movement. Inform us of needs in advance. Participation is voluntary and at your own risk.
11) SERVICES (READINGS, ENERGY WORK, FACILITATORS, ETC.)
No Refunds
All services are non-refundable once booked or performed.
Not Medical/Legal/Psychological Advice
Readings and metaphysical services are for spiritual guidance and entertainment only and are not a substitute for professional advice.
Client Responsibility
Clients are responsible for decisions and actions. We do not guarantee outcomes.
Recording
Recording services is not allowed unless the practitioner and shop approve.
12) CRYSTALS: POLICIES & DISCLAIMERS

Crystals are natural; inclusions, fractures, chips, and variations are normal.

No guarantees are made regarding energetic outcomes, healing, manifestation, or results.
-
Crystals are not medical devices and do not diagnose, treat, cure, or prevent any condition.

Customer assumes responsibility for safe handling, storage, and use.
13) PLANTS: POLICIES & DISCLAIMERS

Plants are living and can experience shock from transport, temperature, lighting changes, and watering differences.

We do not guarantee survival once the plant leaves our care.
-
No refunds/exchanges for plant decline, pests after purchase, leaf drop, or death.
-
Customer assumes responsibility for proper care and environment.
14) APOTHECARY / HERBS / OILS / INCENSE: DISCLAIMERS

Products are not evaluated by the FDA.

Patch test before topical use.
-
Discontinue use if irritation occurs.

Keep out of reach of children and pets.
-
Consult a licensed professional if pregnant/nursing, under medical care, allergic, or sensitive to essential oils/herbs.

We are not responsible for adverse reactions or misuse.
15) METAPHYSICAL DISCLAIMER
All metaphysical products and services are offered for spiritual, educational, and entertainment purposes only. No guarantees are made regarding outcomes. Customer/attendee assumes responsibility for use and participation. We do not provide medical, legal, or mental health services.
16) ARTISAN / THIRD-PARTY PRODUCT POLICY
Many products are made by independent artisans. Items may vary in appearance and materials. Highly Mystical Creations is not responsible for misuse, allergic reactions, or product performance. All artisan sales are final.
17) LIMITATION OF LIABILITY / ASSUMPTION OF RISK
To the fullest extent permitted by law, Highly Mystical Creations is not liable for:

injuries, accidents, slips/falls

allergic reactions
-
misuse of products
-
spiritual/energetic experiences
-
lost/stolen personal items
-
pet/child incidents
Participation and purchase are at your own risk.
18) FORCE MAJEURE (UNCONTROLLABLE EVENTS)
We are not responsible for delays, cancellations, or failures caused by events beyond our control, including weather, natural disasters, power outages, illness outbreaks, supply disruptions, carrier interruptions, or government restrictions.
19) POLICY ENFORCEMENT STEPS

Serious: immediate removal + potential law enforcement
Staff discretion is final.
20) CONTACT & POLICY QUESTIONS
Questions must be asked before purchase/booking. Completing checkout confirms acceptance.
🔒 CLOSURE, FINAL ACKNOWLEDGMENT & ENFORCEMENT
By entering Highly Mystical Creations, making a purchase (in-store or online), booking a service, attending an event, or remaining on the premises, you affirmatively acknowledge and agree to the following:

You have read and understood all shop policies, rules, terms, and disclaimers as outlined in this document, whether posted in-store, on our website, on event pages, at checkout, or on receipts.

You voluntarily consent to comply with all policies while on the premises, participating in events, engaging in services, or using any product purchased from Highly Mystical Creations.

You accept full personal responsibility for your actions, behavior, purchases, use of products, participation in events or services, supervision of children or pets, and adherence to all posted rules.

You understand that all sales are final, all event tickets and services are non-refundable, and exceptions—if any—are granted solely at the discretion of Highly Mystical Creations.

You acknowledge the assumption of risk, including but not limited to:

Physical risks associated with being in a retail environment

Allergic or sensitivity reactions to plants, herbs, incense, oils, or other products

Emotional, spiritual, or energetic experiences

Risks associated with live plants, fragile items, sound, scent, or group activities

You agree to release, hold harmless, and indemnify Highly Mystical Creations, its owners, employees, contractors, facilitators, artisans, and representatives from any claims, damages, losses, injuries, liabilities, costs, or expenses arising from:

Your presence in the shop

Your purchases or use of products

Your participation in events, workshops, or services

Your supervision (or lack thereof) of children or pets

Violations of shop rules or misuse of products

You understand and accept that Highly Mystical Creations makes no guarantees, express or implied, regarding outcomes, results, manifestations, healing, or spiritual experiences.

You acknowledge our right to refuse service to anyone, at any time, for any lawful reason, including but not limited to violations of shop policies, disruptive behavior, theft, harassment, or actions that compromise the safety or integrity of the space.

You agree that staff judgment is final in matters involving policy enforcement, safety, and shop conduct.

You understand that failure to comply with these policies may result in removal from the premises, denial of future service, permanent banning, or involvement of law enforcement when necessary.
